Her father is not on the birth certificate. I was planning on moving to Michigan. I wanted to move but I was scared if I did and her dad took me to court if I’d get in trouble or charged for kidnapping. He has been threatening me for custody, and he isn’t mentally fully capable. He lives with his father and the living conditions aren’t even suitable for a child, so I don’t want her living there. I don’t mind him seeing our child at all. Is it safe for me to move?
If you are not married and have never been to court concerning custody, then custody is with you as the mother. He may file an action for custody or visitation when he finds out about the relocation. To be safe, you should contact a lawyer in your area to discuss the custody and relocation issue before you actually moved.
