I was supposed to claim my daughter this year on my taxes but her father decided to do it behind without telling me. We agreed we’d take turns. I would like to have this added to our agreement so he doesn’t do this again. We have 50/50 custody. Is this something that I will have difficulty adding and granted. He says he claimed her because he pays for her to go to private catholic school. I made it clear it’s too expensive for me.
This would not be a custody issue, it would be a support issue. You can sign a stipulation and have the Court make it an order for you to alternate taking the child's dependency exemption.
The self help center on the third floor of the Ventura County Court house will be able to help you with this.
