The house next door to me (a rental) has it's own dedicated driveway (leads behind the house to the back door from a side street) but the people who rent insist on parking on the side of their house instead of using the driveway. This has caused cars to be parked that are hanging over the property line and blocking me from having full access to my driveway. There is a double wide port leading into my driveway from the street leading directly in a straight line to my double wide garage. I have no idea why the renters insist on parking on the side and ignoring their own driveway. I can only think the landlord is telling them it's a shared driveway although I don't see how it could be. They are essentially parking in their side yard. There is no pavement or gravel down or any other indicators that would suggest it's a driveway and not a yard. I want to put up a straight fence that divides my property from that one but I am afraid the landlord will make an problem and say I am blocking access to the "shared"driveway even though I don't see how anyone could argue that house has 2 driveways because it's a single family home and is not cut up into apartments. Can I legally put up a fence?
Go to the recorder of deeds and find out whether there is a recorded shared driveway easement.
