So we live in NH and are in the process of divorce/mediation. We DO NOT have any court orders yet for parenting plans or anything like that. I don’t agree with my 17 month old being watched by his girlfriend when her father goes to work. She isn’t harming her or anything. I just feel since I’m a stay at home mom I should have first opportunity to watch her. I’m going for first right of refusal but until then can I legally pick her up if the girlfriend has her with no issue? At least until a court order says otherwise?
Assuming for the moment it would be legal, it would not be advisable. First, you could be charged with criminal trespass. Second, you would create the perception you are a crazy person. Third, it would undoubtedly be traumatic for your 17-month old.
File a motion with the court and request a temporary hearing and the appointment of a Guardian ad LItem.
