After dropping some toast while serving food and already correcting my mistake. My boss comes into the kitchen yelling name about the customer asking him about the replacing toast. I replied letting him know the situation was being taken care of. He replied yelling with excessive profanity and that I just do what the he'll he says. Feeling that was a bit agressive I stated he didn't have to curse at me and that I would appreciate some respect. He states that it's his restaurant and he doesn't have to respect me and walks off. With that being that I continue on with my duties. He then returns to the kitchen chest pressed against my shoulder and index finger firmly in my face. Again he began to profanities and belittle me in front of our co-workers telling me that of don't open my mouth to him when I'm spoken to almost as to intimidate or threaten me. To gain some personal space and to also not have his finger in my face I stepped away from him, and again I asked him to not point his finger in my face and for some respect. There is no circumstance where your supervisor or employer should physically touch you or intimidate you in the manner you have described and this may give rise to an assault claim. Further, even where an employer has decided to terminate an employee, it must pay you your earned wages. I am not sure how much you are owed, but I would recommend that you speak with an employment attorney or contact the Illinois Department of Labor to discuss your options.
