We can no longer afford the mortgage payments, have not been able to sell the property and don't want to be sued in foreclosure. Can we just give the property to the bank?
You are talking about a Deed in Lieu of Foreclosure. You can offer to do that. But the bank does not have to accept. You should find a debtor's attorney to help you negotiate the terms of the deed in lieu of foreclosure.
