My sons father has not seen my son in a year. He stopped contact with me and stopped answering my messages. He has stopped sending child support. It has been 22 weeks since I received a check. I am looking to have his parental rights revoked. I want my husband to adopt my son. My husband considers him his own as he has been in his life for 6 or the last 8 years. there has never been a custody order or support order in place. We were never married. Can I have his rights revoked and have my husband adopt my son?
Based on the limited information you've provided, it sounds like the Court may consider revocating your child's biological Father's rights and allowing your spouse to adopt him. There are several steps, however, before such a petition would get allowed, as the Courts give the biological Father multiple opportunities to object to such a petition. I would suggest consulting with an experienced Family Law Attorney in person to further discuss your exact circumstances and to help create a plan to begin this process.
