My childs father left and moved out of state in Aug 2015 (1mth after childs first birthday). He hasnt called, visited or paid child support. I filled out the name change legal form for KY and sent it via certified mail to him to sign. He refused to accept the first time I sent. The second time I sent it he accepted but hasnt responded or sent it back and its been a month. Can I legally take these receipts and the form to the courthouse to have the childs last name changed from his last name to my maiden name so the child has the same last name as me and the sibling?
If you have a family court case you can make motion in that case for the name change and present your evidence at a hearing. If you do not have a family court case, you can go through the probate court. The Judge will decide whether to allow the change or not.
