was in a MVA while working. Workers comp judge ordered no surgery and my lawyer is appealing. Now my personal injury lawyer is having me go for the sugery under my medical insurance. Is this okay??? Will the workers comp judge have a problem with it???? Will iyt hurt my workers comp case???
It is difficult to answer the question without more information and a copy of the order. However, it appears that the judge ruled only that the workers compensation carrier should not pay for the surgery. That does not preclude you from getting the surgery, and your insurance carrier paying for it. The judge cannot order someone not to have surgery (under most circumstances). You should rely on the advice of your attorney. He is familiar with your case, and he is familiar with your state's laws.
