Can I post a sign in my yard warning of poor service from my home builder? Missed every deadline, won't respond to requests from warranty work, and misrepresented themselves. it is my property, and would like to post 4' x 4' sign ( not in HOA area)
You should seriously consider not doing such a thing.

Being sued, and losing a law suit are two different things. So, yes you can be sued. Depending on what you post on the sign can make it easier for the builder to win a lawsuit against you for defamation.
