My husbands dad has never had n e thing to do with him and we just recently learned he passed away in January what do I do
In what state was your father in law a resident when he died? If in Kentucky, your husband can petition to be administrator of his estate in the County in which his father was a resident when he passed. Your father in law's spouse and any other of your husband's siblings could do the same and then the Court would have a hearing on who can administer the estate. Then the estate passes by intestate succession. If someone produces a will then the will lists the executor who is to be appointed to probate the estate and how the estate is to be divided per your father in law's wishes. A probate attorney should be consulted if your husband is wanting to be appointed administrator.
