My charge was dismissed because i paid the fee and went to a class it was also my first offense but I heard it still comes up in a background check even if it was dismissed? Am I able to get if expunged? I’m a junior in college and I don’t want to be struggling to find a job after graduation for a stupid mistake I did
There is no way to expunge a record in Arizona. A dismissal is the best you can do. If you were charged and the prosecutor later found out that you were innocent, your record would show the same information.
If you were arrested or charged, a background check may still show the original charge. But if it was dismissed, then the background check should also reflect that it was dismissed. Unfortunately there is no such thing as expungement in Arizona, but the state does allow for Motions to Set Aside. However a set aside would not apply to your case because you were never actually convicted. Best of luck to you.
