Help me I gave birth and from the hospital acs accompanied me to conference and had y infant removed cause my elder son is in foster care I had to move out of my house so my infant wont go into custody of state this just hapen monday what can I do to go back home and be with my son and my lawyer isnt a ptbull in courtcan I go and petition for custody on friday please help me
What is the reason that ACS made you leave the home? Is there therapy/rehab that you can attend that would have ACS view you in a different light? What was the reason for your older son being taken? You need a course of action that can show ACS that you are a fit parent. If you do not do that even the best lawyer can not get you what you are asking for. You have a right to a "1028 hearing," which is a hearing to challenge whether the child should remain in foster care pending a full trial. You can file a petition for a 1028 hearing by going to the Family Court in the county where you reside. How successful you'll be depends in large part on whether you've remedied the issues which led to your 1st child being taken away.
