Sept. 9 this year and still Barry the owner (A Astro home improvement co. )keeps telling me (through text) "I am shooting or next week, " (Nov. 9), "I am so sorry for the wait", Nov. 28 then I texted said; " a week after Thanksgiving." I sent him my new phone number . My son called him he said "Thursday the 26th . He called me said "tomorrow " (Dec 27th) I text him and asked him "what time they be here?" no answer. I gave him 1100 for deposit the contract says if I go back he keeps a third. I am not going back he committed to install my gutters. I did do a BBB complaint on him. I am tire of waiting. I know he is doing other jobs ahead of my.
Send a demand letter for the deposit, citing his repeated failure to perform. When he fails to return your money, sue him in small claims court.
