Seller did not disclose many property damages and her personal belongings hide us seeing damages. They also had structural damage in the past with repairs not done properly and properly did not use a licensed contractor , Also never told us about the damages
The PA Seller Disclosure Law allows recovery of actual damages. It does not include attorney fees. A law suit under this law must be brought within 2 years of the date of final settlement. However, you may also have a claim under the PA Unfair Trade Practices and Consumer Protection Law which does allow for recovery of attorney fees and up to triple damages.
You may also have claims for fraud and misrepresentation and if a home inspection was done, a claim against the home inspector but this suit needs brought within 1 year from the date you received the report. Depending on the facts, you could claim rescission to void the entire deal.
