I had to resign the day the settlement was signed, therefore losing my job health benefits.I also lost the workers comp medical benefits because in FL they won't pay future medical after a settlement. I can't afford Cobra because I have no job & I haven't received the settlement money yet to use for Cobra. I have several pre-existing conditions & can't get private insurance. Can I qualify for Medicaid now? And will I no longer be eligible once I receive the settlement money? Also if I can qualify for Medicaid, will I have to pay Medicaid back for any money they pay out while I'm waiting for the settlement money? I am not disabled & am looking for a job, but haven't found one yet.
Very tough situation. In Virginia, we have some free clinics and University State hospitals that will provide some medical care that you are talking about. The problem ( and EACH state's laws differ on Medicaid) is that Medicaid is based on NEED and you may qualify now, but they may have a lien on your settlement which would have to be paid back. This may be different under Florida Medicaid laws. The real problem is that since it is based on need and you will be receiving a lump sum, the minute you get the money, you would not be eligible for Medicaid from that point . I reccomend calling the Medicaid office near you to see the qualifications and what will happen when you receive the lump sum and also look around for free clinics.
In Florida, it is not uncommon as part of a settlement to ask the carrier to advance part of the settlement money while paperwork is being prepared and approved by the judge. For example, the claimant might settle for $20,000, and the carrier agrees to pay $2,000 of that amount immediately and then the remaining $18,000 once the $20k settlement has been approved. You already reached your settlement agreement; but, there's no harm in asking the carrier to advance you a portion of it now, especially since your reason (to pay for COBRA) is a valid one.
