I had a paternity test done and my name added to birth certificate of my son. Never was sure if he was mine til he was 4. He lives in colorado with mom &im in Texas. I pay child support but no parental time established. She has seemed ok to let me visit him and have him during vacations but she randomly changes her mind depending if she gets upset about insignificant things or if something isnt pleasing to her. I want to bring my son to visit my family and i, but worry if she changes her mind while i have him &insists i take him back immediately n i dont right away if i can get in any kind of trouble?
Your uncertainty about transporting your child is understandable. Unless there is a custody order prohibiting otherwise, either parent may transport the child to a different location, however not withhold contact from the other parent. It sounds like you should establish an allocation of parental responsibilities though to set forth physical and legal custody and parenting time. You can consult with an attorney who can assist you in filing an action for Allocation of Parental Responsibilities.
