My mother and her husband were together for 14-15 years, my stepfather has full custody of said child. My mother passed away in July of 2017 leaving him to care for said child alone. Said childs mother came back into the picture but doesn't have necessities to care for said child when she moves from my stepfathers home, parents cant get along so she has to move. I'm concerned for the care she'll get once on her own with father, due to him working I feel she would be better in my care with help with school & doctors, one on one figure she needs. Can I get custody of her?
Does he work out of town? Plenty of people work and care for children. Is she a teenager? In order for you to get custody, the father and mother would have to agree or you would have to show that the child was abused or neglected. You would then need to show that you were capable of caring for the child. You should consult an attorney to review all of the facts and advise you.
