I'm tired of my ex for the way she manipulates my 9yr old son. She smokes weed infront of him, has not bn employed since having him. Has her bf living with her illegally cause she on metro. Sells her food stamps that r for my son then says how she uses the govt money/benefits and childsupport is none of my concern. If she is to messed up in the head to hold a job how can she raise a person?
You have a custody order in place that you believe should be modified due to her behavior, right? A court will consider many factors in the determination of the best interests of the child. The behavior you describe, assuming you can prove it to be true without involving the child, certainly sounds compelling, but what will she say about your behavior? If this is the case, why have you waited 9 years before trying to get custody of your son? If she is untreated bipolar and has current/recent drug offenses, then yes this can be part of the evidence that you use to show it is in your son's best interests for you to be the residental parent. You will likely needs to show more evidence than just that, but it is a good start and an attorney can help you develop a well rounded argument for your obtaining custody.
Expect a fight on your hands, as you make it sound that you are taking away her meal ticket. She will fight to keep the child support plus the extra benefits that your son gets her since your questions make it appear as if she is dependent on these items.
