It's impossible for anyone in this limited forum, or even through the course of full representation, to guarantee the outcome of a custody case. Judges have extremely broad discretion in entering custody orders. The only question they have to answer is "what's in the best interests of the child" and that question means something different to every judge.
A million factors will come into play, not just the situation you asked about. Age of the child, living situation of both parents, custodial arrangement up until this point, medical or educational needs of the child and which parent addresses those, parent's work schedules, child's involvement with extended family members on both sides, discipline in both homes, the type of people hanging around both homes, etc.
