I have joint custody of my 5 year old daughter and I take her 2 year old sister during my custody time. The child's dad is deceased and has been for over a year. I want to get legal rights and visiation to the 2 year old. Is that possible without having to adopt? The mom is agreeable. We are in arkansas.
You could if you can establish that you have stood "in loco parentis (in place of a parent)" to the child. If the mother is agreeable, the Court may approve an agreed order making that finding and awarding you visitation.
