The attorney for the defendant can request copies of all favorable evidence and also all material evidence that is not otherwise privileged. If you are not the defendant then you are limited to whatever you can get via an Open Records request (Public Information Act) unless you can convince the defense attorney to share at least portions of it, since you are a witness, under the restrictions proscribed in CCP 39.14.

I suggest you and your boyfriend hire a good criminal defense attorney . First, your boyfriend will need one to counter the assault charges, or whatever they decide to file. Second, you will now need an attorney because the facts you just outlined are crime as well. It is a crime to file a false police report no matter how bad your day has been and what kind of mood you are in. Good luck.
