My sons father did not return him come Sunday after he took him for his verbally agreed upon weekend schedule visit. Then I was served with custody papers. My son was 5 at the time. I was the custodial parent all 5 years. He was healthy happy and safe. But his dad had his own personal vendetta and did not bring him home. Then when court was scheduled I had a very unfortunate obstacle in my way that was out of my control. There was a suicide jumper on the freeway and all traffic was at a dead lock making me 12 min late for court to find out his father was given everything he asked for in his requests. Full legal custodial everything. Leaving me with supervised visits through a company. This seems a little extreme given the situation. And I have no legal history, drug history, or any reason why my child is unsafe with me and I lose everything. Is this fixable?
To get the best responses from experts in the speciality, I recommend that you post your question under the topic of child custody.
Yes, this is fixable but you need to file a Request for Order to modify custody and visitation immediately including a request for reconsideration of the courts order based upon the circumstances that you stated. Give the court as much information as you can and include any and all facts that refute what the father stated in his Request for Order that he filed with the court. I may be overreading this, but it would appear that you may have been set for at court mediation based upon an ex parte motion filed by the father and you were not present at the time set for mediation so the court made temporary orders. If so, you can and must file your requests to modify immediately.
I suggest you file a Request for Order to vacate the previous order based on your inability to make it to court, and have a full hearing on custody.
