Misdemeanor shoplifting $28
It may be worth it to see if the manager/loss prevention would in exchange for returning the items; however, it also depends largely on the prosecutor. Being such a low amount, this will likely stay as a misdemeanor. That being said, the fines that you are looking at far exceed the amount in question, and this will go on your record. You may want to consider hiring a criminal defense lawyer to see what can be done, with the goal of trying to work it out to where this does not go on your record.
It would be in your best interest to consult an attorney to see if you have a defense.
