About five years ago I did a stupid things, I hacked into a girlfriend business email account. She then accused me of being a computer hacker, got her sister a U.S. Federal Judge and the FBI involved. I ending up doing a plea. Most federal courts, including those here in the Sixth Circuit, will only expunge records of conviction if something unconstitutional took place in the proceedings. They will not expunge records for equitable considerations, i.e., because you've lived a law abiding life for a period of time and need help finding a job.
"We share the view of our sister circuits that, post-Kokkonen, federal courts lack ancillary jurisdiction over motions for expungement based on purely equitable considerations, yet retain ancillary jurisdiction over motions challenging an unconstitutional conviction.
