I was driving through an intersection a few days ago and as I almost got through the light when a truck hit my back passenger side. I remember my light being green and he claims his was too but I got the citation. there were no witnesses and apparently the red light cameras were deactivated in 2015 (i did a google search). Because there is no evidence can my charge be dismissed??
The evidence will be the testimony of the other driver. If you set the case for trial and he does not appear then, yes, the case will probably have to be dismissed.

Likely, it will not be outright dismissed. The above attorney is correct that if they do not show then it will likely be dismissed. However, it is much more likely that if you negotiate with the District Attorney with the use of a lawyer you can get this negotiated down from the careless driving to a lower point ticket.
