I have been renting a house from my dad, who I have a lease agreement, everything's in writing. I also live with my sister who is also a tenant. My brother moved in recently and wont leave due to financial complications. he sold his car, tv and computer, and was evicted for not paying his rent. he's now living here and does have income. He receives regular disability checks for a mental problem once a month. However, he spends all his money on drugs (meth) that only worsens his condition. He lays around and does nothing productive with his time. I want him to move out, what is the legal procedure for this, if he cant live here, he may wind up in the streets, not my problem or in a or worse. What do I have to do, get a restraining order or is it simpler, can I just force him out?
It is not advisable that you physically force someone out, especially if he is under the influence of drugs. You can use the Find A Lawyer tab at the top of the page to find someone to help you.
