My sister and I live in NC. Our mom passed on 12/13/2019. We know there is a will and my middle sister all of a sudden is in charge. Their are 5 of us that my mom left everything to be split 5 ways including her house. My older brother was the executor of the will now all of a sudden my sister is in charge. Can we find out if it's the same will or my sister had it changed
If the Will has been filed with the probate court it will be a public record. Check the county in which she resided at the time of her death. Ask your sister for a copy of the Will. Not all assets are controlled by a Will though. Any financial asset that had a payable on death beneficiary would trump the Will. If she is using an attorney to help administer the estate you should receive a letter the next few months that gives you an overview of the process. Don't expect any assets to be distributed until at least 6-7 months after the date of death. If it is a complex estate it could take even longer than that. Sorry for your loss.
