Since this happened in Florida, that would be the proper jurisdiction. I don't know the statute of limitations in that state, but the issue would be whether the time would run from the discovery rather than the event. Then there is the question of "damages": since the bullet was in you all those years and you didn't even know it, how would you prove that you were harmed by the failure of the hospital to remove it all those years ago?
You would have to double check the laws in the state of Florida, but given the extensive period of time that has elapsed, most likely the statute expired. I only practice law in New York so I don't know Florida law. However, it is my understanding that it is very difficult to pursue a malpractice case in Florida.
