When I was 11 years old my aunt and I was shot. I was treated for a bullet that went through my left foot. I'm just now finding out that there is a bullet in my back. I started complaining about pain in my back a few months ago. My doctor ordered an x ray. He asked me had I ever been shot? I told yes in my foot. That's when he told me that there is a bullet in my back. I was shocked to here this. My aunt tried to cover and protect me. She got shot 5 times and lived. This happened in my aunt friends home. This happened in Vero Beach Florida. It was all over the news media and the papers. If I can sue. Do I get an attorney here in New York or Florida? It happened when I was 11 yes old. I am 65 yrs now. If the statue of limitations has run out. What else could I do.
This happened some 55 or more years ago. I’m afraid every conceivable statute of limitations has expired
You would have to double check the laws in the state of Florida, but given the extensive period of time that has elapsed, most likely the statute expired. I only practice law in New York so I don't know Florida law. However, it is my understanding that it is very difficult to pursue a malpractice case in Florida. I would strongly recommend that you contact a Florida lawyer.
Since this happened in Florida, that would be the proper jurisdiction. I don't know the statute of limitations in that state, but the issue would be whether the time would run from the discovery rather than the event. Then there is the question of "damages": since the bullet was in you all those years and you didn't even know it, how would you prove that you were harmed by the failure of the hospital to remove it all those years ago?
