My roommate and I were served UD due to roommate unable to pay rent in March 2015. My portion of March rent paid and kept my landlord. We filed separate responses to UD. 4 months later landlord's atty filed for settlement conference and trial dates. Court set dates for settlement conference the day of leave to see family in Midwest, and trial date while I'm away. Can I file continuance to have these postponed until mid August?
You can try, but unless you agree to advance the dates, and the court can accommodate, you may have trouble getting the court to delay (absent agreement by Landlord atty). Usually both tenants are jointly and severally liable for the full rent. So even if you had deal with room mate to split rent, if he/she doesn't pay her share, you have to, or risk eviction.
You can ask. Contact the attorney for the other side and your roommate and ask them for a stipulation. If they don't agree, you will need to bring a motion. Even with a stipulation, some courts still require a motion.
