My ex-wife received the marital home in our 2015 divorce. She was to get my name off of the mortgage within a reasonable length of time thus, holding me harmless. It has been four years and she has yet to remove me from the mortgage. She has missed several payments over the last four years, and this has drastically hurt my credit and debt ratio. The mortgage is around $220,000, and I can't buy another home because of it. I am remarried with a young family. What can I do to hold her accountable for following the decree? Thanks.
You will need to hire an attorney to file a contempt. Hopefully something can be worked out, and in the impossibility of her refinancing, I really don’t know what to say without more information. I would talk to an attorney about getting a contempt filed to get the ball rolling...
You definitely need to get with an attorney, because your wife is in contempt of the divorce decree. Sadly, these things happen quite often, but are relatively straightforward when it comes to prevailing.
I would encourage you to speak to an attorney sooner rather than later, since the more time that goes by, the more your credit score can be damaged. Feel free to reach out to any attorney on here by clicking the contact information next to their name. Most attorneys on here, myself included, provide free consultations to see how we can help.
