I have always filed Federal Taxes, but never completed my state taxes. I have paid state taxes for over 10 years but never claimed the returns for those taxes. Can I file my state taxes for previous years and get any refund due to me?
Unlike the federal law that has a 3 year statute of limitations, California has a statute of limitations of 4 years. That is, you can only claim a refund for the 2012 tax year IF you file on or before 4/15/17, and the 2013 tax year IF you file before 4/15/18, etc. Having said that, you are encouraged to file CA tax returns every year because if you do not, the statute of limitations remains open forever for the FTB to assess you. That is NOT a good position to be in! Good luck.
