I have not had any income since June 2016 since my serious health problems. I have a huge debt and being sued recently by Discover Bank which I have had a relationship for many years and always paid all credit cards on time, and so on. I had to travel outside of USA (I am a US citizen) because my mother has been very sick and in a hospital for over 4 months. She was recently re-admitted to the hospital. In the country where I am from it is a criminal offence to abandon your elderly parent, besides this is my mother so I could not do that. I have been out of the country for about 8 months now but I wanted to file for bankruptcy because I do not see any possibility to continue any payments without any income. Can I do that? And if so, what would be the best way to handle if outside of USA? By the way, the Discover Bank was harassing me when I called them and informed that I had to stop paying because I could not, and that I had to travel abroad-I was receiving the e-mails and harassing calls from the bank and their agents. Just recently they obtained the Default Judgement against me while I tried to get the continuation of the case because I could not return to the US for the hearing
i have filed bankruptcy for folks several times in your situation. For the meeting of creditors, the debtor flew in. The time and money needed to arrange the meeting out of the country is likely to far exceed the cost of a plane ticket.
You can file the application. You would likely need to be present for the creditor's meeting. You should contact an attorney to assist you with the process.
