I filed an EB1 adjustment with I-140 a year ago. I was on O visa but it is now expired. I just got back a really bad RFE that my attorney says we won't win on. He also said he has had cases not as good as mine that have been approved but it is very uneven results with Immigration. Can I leave this one pending and submit a new I-140 with premium processing hoping for different results and if approved, submit new I-485 and then withdraw old one.. If not, I am deny and then what do I do?
