You could sue in Small Claims Court. There is no "overcharge" since any rent charged by a tenant to another person within NYCHA is an unlawful charge. Courts often take the position with an illegal rental that both sides committed a wrongful act; or if you were able to live where you were, you received the housing you bargained for.
