I am currently incarcerated but 11 yrs ago i was federally indicted on different charges and i was told i would get a rule 35 but instead i did all my time can i file a civil suit against the fedreal process attorney for not giving me that rule 35?
Can you file suit.
You could certainly try. But suing a prosecutor for something that is entirely within his discretion to do or not do probably won't go very far.
Now, if you had an enforceable plea/settlement/cooperation agreement, maybe. But it doesn't sound like you have one of those.
