Was it a joint account? I doubt the police would care about this, but I suppose you could sue him in small claims court. What happened, the honeymoon's over?

You need to file a lawsuit in civil court ( a small claims suit depending on the amount) for fraud, at least, and possible identity theft and since it was intentional you could possibly claim punitive damages. You have NO rights as to any community proerty laws since you weren't married.
