You will need to file a petition for paternity and have paternity established before you will be granted parenting time.
If your son knows another man to be his father, there is a chance that the court will not allow you to prove paternity based upon estoppel. In New York, the relationship determines paternity, not necessarily biology. For estoppel to preclude you from obtaining paternity, the court would determine it was in your son's best interest to continue the relationship with the man he believes to be his father.
