I was charged with possession of a controlled substance while in a motor vehicle and took the A.R.D program. I finished the program and got my record sealed but was wondering if I could have the record expunged off my motor vehicle record.
If you resolved the matter through the ARD Program, then it should not have even been put on your Driving Record, unless you have Commercial Driver's License (CDL). If you do not have a CDL, and it is appearing on your record, yes it can be cleared through the process of expungement. If you have a CDL, it is more problematic. PennDOT is fighting such expungements, but I do not think it has been challenged in the Courts.
I suggest you speak to counsel and they can tell you your options.
