I am facing DUI number 3 however it was charged as a misdemeanor because i had only been convicted of one at the time. When this finally gets resolved will i be able to reduce my fines via community service? Also will they charge this as a felony as i did plead guilty to dui #2. This is set for trial late summer but still filed as a B misdemeanor.
If this is your third DUI within ten years, and it is filed as a misdemeanor, you need to consult with a skilled DUI attorney. The state can dismiss this charge and refile it as a felony if they realize you have two prior convictions. If you have a court appointed attorney, discuss these new facts with your attorney.
If you've hired an attorney to represent you on this matter, call your attorney and stop posting questions on a public forum. Let your attorney work for yo.
A third DUI within 10 years will be charged as a felony if discovered. Most courts will entertain some community service in lieu of fines but you should check with your attorney.
Call your attorney, as has been suggested. You need to avoid the felony. Nothing else really matters. Quit worrying about the fine and start worrying about doing 10 days versus 62.5 and being a felon for the rest of your life. Plead. Plead now. Good luck.
