Besides the point made by my colleague about the company's disclosure of false positives, I think there's a problem with demonstrating an injury. In other words, you can't bring a lawsuit unless you have damages. Being upset that you had a false positive isn't going to suffice for damages. And bringing the claims as a proposed class action won't cure that problem.
