Non custodial parent hasn't shown up five times for visitation. Claims an emergency came up only to find out he went out drinking. He also let people who aren't allowed around the child per court order come over on his first visit and was drinking which is also not allowed per the order and left the child at his families so he could spend the night with a girlfriend. It has been five times in a row that he says he will get the child then makes an excuse. He is also being emotionally and mentally abuse to me the custodial parent and has a history of it which is a part of why custody was changed. Can I refuse him his next visit until court the next week? Where I will be asking for supervised visitation only?
Missing a prior visitation, or more than.one, is not a vadis to deny visitation.
If the other parent is violating the order and the safety of s minor is a real concern, seek an emergency order suspending visitation.
Self-help can see you facing a contempt action. If you have a valid reason to stop a visitation, tell it to a judge.
