Can I deal or expunge a dismissed "theft by check" charge in Texas?
Hi, I had written a check to my old community college bookstore in 2008 that came back insufficient funds. I had moved away to university after that summer. It went to warrant status for not responding to letters allegedly sent and sat there until I did a search in 2011 and saw a warrant for my arrest for "Theft by Check - Less Than $500". I contacted the county attorneys office and they agreed to dismiss for "restitution paid", I just had to pay the original check, they'd waive everything but the filing fee. I took care of it. I had another check come back in 2015 while I was in the middle of my divorce and had moved. I never knew it had bounced. I had a non-related court appearance and was arrested because the court clerk saw a warrant for "Theft by Check $20-$500". I was handcuffed and taken to the holding cell in next to the court room. My lawyer for my case got them to dismiss it if I could pay the check amount and fee on original mailer. My wife paid and it too was "DSMD - REST PD/FULL".
Since they were dismissed, can I have these sealed or expunged? They've never kept me from a job, but I'd prefer they not be visible at all to background checks.
