Biological father is sueing for full custody and 2x the amount of child support he gave.
Tried to get emergency custody and restraining order but had no grounds for that. He added a bunch of clauses on things he and his family did. For myself not to due. Like talk about the law sue and financial cost. Or manipulation on my daughter. There is alot more. Can I counter sue? For emotional distress of a minor, of myself and family? Financial distress of this ridiculous law sue? And reminder I have proof of his uncaring via text. Wanting to give her up via text. And her own words of "why my dad dosent want me" through private diaries? He found out once she turned 13 she can choose who she wants to stay with. 14 yrs old now he took her for his allotted summer days. And I was served papers for a law sue. Please help.

You need to take this Motion to Modify in Suit Affecting the Parent Child Relationship seriously. You should have filed an Answer on or before the Monday next after the expiration of 20 days following the papers being served on you. You have every right to file a Counter Motion, seeking to increase child support, and further, asking that the court appoint a child custody evaluator to investigate you, the child's father, and the child to ascertain what is in the child's best interest. You can also move the Court to interview the child in chambers to see what the child may want. Good luck to you
