My lanlord sent me an unacceptable amount of my refund wit an itemized check list that is clearly illegal. Plus, he was over the 21 required days in returning my refund and received it 6 days late. Anyway, he still owes me $925.00 more than the check he wrote me for $782.00. If I cash the check, can I still sue for the rest? The notation he wrote on the check says "security deposit refund."
Yes. Unless the check clearly says something like "in full payment of security deposit refund" you should be able to cash it and still sue the landlord for the remainder.
