I have my current employer sponsored EB1A (Extraordinary Ability) I-140 approved in April 2018. I m planning to change jobs. Should my new employer apply for my I-140 again or can I use my previously approved petition? My new employer wants me to wait another year before they will start another petition. So was wondering if can I self petition another EB1A petition and what are the chances of approval, as my previous I-140 was already approved in EB1A.
You are entitled to use the priority date from your approved EB-1A petition unless this petition is/was revoked due to fraud or willful misrepresentation of a material fact, a determination that there was a material error, etc. See 8 CFR 204.5(e)(2)- http://www.nafsa.org/_/file/_/amresource/8cfr2045.htm.
