You must be served no later than 10 am the day before an ex parte hearing and usually custody issues are not decided on an ex parte basis.
I agree with Ms. Vaccaro. If you received notice by 10:00a it is valid. Even if you didn't, show up anyway as you don't want any orders made against you that you don't have the chance to be heard on. You should prepare written objections because not all ex-parte's are heard orally.
Here is the speech: you have children involved. They are important, or should be. Get an attorney. If you cannot afford one try legal aid, the local law school, local organizations that assist with children's issues, or the bar association.
