I'm a Senior Operation Director and I terminated a employee who is 70 years of age after I terminated her she filed a lawsuit with the EEOC saying I subjected her to a hostile work environment and terminated her because of her age all which are false. I started writing her up after she continued to not do her job and when I did this she went to HR and filed a complaint and nothing was found after they did an investigation. 6 months later we terminated her with the approval of our corporate HR person. The ex employee filed a suit has an attorney we had a unemployment hear that didn't go good I think and now my company has legal counsel interviewing me in 2 weeks. Question should I and can I get legal counsel to represent me in this case. Also is there a case for slander from this ex-employee? Thank you very much for any in site.
Yes, you can get your own counsel. It is tough to prove individual liability if the employee was acting pursuant to the directives of their company, but it couldn't hurt to speak with an employment attorney licensed to practice in Connecticut if you have questions. It will be tough to speak to someone until Tuesday because of the holiday, but call someone first thing Tuesday morning to arrange to speak with before your interview if you want.
