I renewed a contract in December of 2015 with my now former employer. The contract has a non compete or restrictive covenant clause saying I cannot compete directly within a 30 mile radius and for one year. After reading 2015 Arkansas Code Title 4 - Business and Commercial Law Subtitle 6 - Business Practices Chapter 75 - Unfair Practices Subchapter 1 - General Provisions § 4-75-101 - Covenant not to compete agreements I saw that Section (j) This section shall not: (2) Apply to a person holding a professional license under Arkansas Code Title 17, Subtitle 3.
As this law went into affect prior to renewing my contract will this law supersede the covenant in my contract? My contract also states that the contract itself is being governed by the laws of Arkansas.
The exception applies only to nurses. You did not mention what type of medical professional you are. Covenants not to compete are notoriously difficult to formulate and uphold. You do need a local counsel to peruse the actual wording of the covenant.
