We were just stopped by law enforcement and we made it clear there was one present and that I was a felon
I can imagine such a situation would generally result in your arrest and for felon in possession. I’m assuming from your post to the officer did not make an arrest…If that is the case I think you got very lucky. Smart thing to do would be to meet with a Tennessee gun rights attorney and discuss the scenarios so that you and your wife understand the risk you are in if she carries a weapon.
NOT LEGAL ADVICE, NO ATTORNEY-CLIENT PRIVILEGE CREATED. FOR INFORMATION ONLY. DO NOT RELY ON ANY ADVICE YOU RECEIVE FROM ME OR ANY OTHER ATTORNEY ON THIS FORUM. Legal advice comes after a complete review of the facts and relevant documents and an expressed (written) agreement of representation that forms attorney-client confidentiality. Neither of these two events can occur in this forum. Mr. Rafter is licensed to practice in the Commonwealth of Virginia and the US Federal Courts in Virginia. His answers to any Avvo question are rooted in general legal principles--NOT your specific state laws. There is no implied or actual attorney-client relationship arising from this education exchange. You should speak with an attorney licensed in your state, to whom you have provided all the facts before you take steps that may impact your legal rights. While you may have a defense in that the gun is locked in the glove box, one of the issues will be if you knew the gun was there. You might win at trial but it's likely to come after being arrested and sitting in jail for months. Is it really worth that? I'd say get rid of the gun. And don't keep it in your house either; that's just begging for trouble.
Nothing in this communication should be construed as creating an attorney-client relationship. I provide this service for educational purposes only. I will take no action on your behalf unless you have hired me and a written retainer agreement is signed. I am licensed only in Tennessee and I strongly suggest you consult with an attorney in your city and state as Statute of Limitation deadlines can limit your recovery.
